The team searched for the tiny lizards under the cover of darkness, using headlamps and flashlights to seek out the sleeping chameleons. All four species are active during the day, and at night climb up into the branches to sleep.

But for such tiny critters, "up into the branches" means a mere 4 inches (10 centimeters) off the ground, Glaw told OurAmazingPlanet, so finding them is no easy task. However, once spotted, the tiny lizards aren't tough to catch, Glaw said.

The team of scientists found the tiny reptiles in Madagascar's wild northern regions during expeditions between 2003 and 2007. For three of the species, "we immediately identified them as new species," said Glaw, a veteran herpetologist and curator at the Museum of Natural History in Munich.

"In general, these tiny chameleons are so small that it's really hard to see the small differences with the naked eye," he said.

The researchers warn that at least two of the newly-discovered chameleon species are extremely threatened because of habitat loss and deforestation in Madagascar.

Glaw, who has been going to Madagascar to research its ever-expanding list of amphibians and reptiles for a quarter century, said that B. micra may represent the limit of miniaturization possible for a vertebrate with complex eyes, but said it's impossible to know for sure since each time scientists have proclaimed the discovery of the tiniest one yet, another, tinier species appears.

"Maybe there's a potential for a smaller species," Glaw said.

Q: I recently moved into an apartment complex and signed a lease for 12 months. Unfortunately, I found out very quickly that neither the terms of the lease nor the community rules and regulations were enforced.

My particular concern is the lack of cleanliness of garbage areas, as well as the ongoing failure of the on-site manager and maintenance person to keep the common areas clean and attractive. Also, there are several tenants who seem to feel it is appropriate to use the common areas as extra storage for personal items.

If I decide to stay, what are my options to try to encourage management to keep the property clean and neat and enforce the terms of the leases with my fellow tenants? If I decide to leave, will the manager's lack of ability/effort to have other tenants comply with lease and rules be sufficient cause to get me out of the lease?

A: My first concern is how you have gotten yourself into this situation. The property's curb appeal would be clearly noticeable prior to signing the lease if you had done any sort of reasonable due diligence or inspection of the property.

Unless you rented the property without visiting it prior to signing your lease, it would be rather unusual for you to not realize the significant and readily apparent problems in the common areas with the storage of personal items and the lack of cleanliness.

I could see how you might not have checked out the trash disposal areas in detail, but the dirty common areas and the cluttered individual unit porches or balconies would be difficult to miss. As is so true with most customer service businesses that rely on aesthetics, the first impression will tell you a lot.

But, let's assume that you did sign the lease without seeing the property, as that is happening more often these days with the Internet being so prevalent. Of course, many rental properties look great online because the pictures are carefully selected (and maybe even cropped) to show only the best views or highlights of the property.

I have heard some tenants even accuse the landlords or their property managers of "touching up" or enhancing the photos; if the grass looks too good it might because it is artificial turf or the photo is digitally manipulated to the point that the grass is too green to be real!

Remember that a lease is a binding legal contract and there are only a few specific reasons that the lease can be broken. Examples would include the landlord's failure to provide the leased premises in a habitable state or a landlord that fails to allow you as the tenant the right to quiet enjoyment or use of the rented premises.

However, a word of caution is in order here. It is my experience that the inability or lack of effort by the on-site manager to enforce the rules about storing personal property in common areas would most likely be a long shot to use as a basis for breaking the lease.

Unless the items create a serious health and safety hazard, it is likely the court will find that it is just poor housekeeping by the property manager.

The court will most likely agree with you that it is aesthetically unappealing but not sufficient in most cases to be grounds for breaking a lease.

However, I would suggest that you contact your local code enforcement department and file a complaint and have them inspect the property and cite the owner if there are any unsanitary conditions involving the property, especially the trash collection area. This may be what it takes for the on-site manager to get the message.

But even before you contact your local municipality to complain about your on-site manager, you should contact the property management company and the actual owner of the property.

They may not be aware of the conditions if the property has severely declined in the past month or so. You can casually ask some of your fellow tenants if these unsightly conditions are something new or the way the property has always been maintained.

Another thought is to contact other like-minded tenants who are also frustrated with the deplorable conditions. The manager might not be worried if you try to break your lease, but if there are five to 10 additional tenants who all express the same concerns then you will definitely get the attention of your on-site manager.

Even a manager who is "leisure-oriented" and does just the bare minimum will soon realize that a slew of vacant units will create a lot more work than just cleaning up the property and enforcing the rules.

Higher-than-normal turnover of tenants or above-average vacancy would also be a catalyst for the property owner to visit the property and make changes, up to and including, a new manager.

I think your best strategy is to make your concerns known and see what positive changes can be made over the next several months.

If there are insufficient improvements, then you should give notice and not renew your lease. Chalk this up to a lesson learned, as you will be certain to carefully scrutinize all aspects of your next place of residence before signing a long-term lease!

Woman wins small-claims suit over Honda hybrid mpg

LOS ANGELES (AP) ? The Southern California owner of a Honda hybrid car won her unusual small-claims court lawsuit against the automaker over the vehicle's failure to deliver its stated fuel economy.

Los Angeles Superior Court Commissioner Douglas Carnahan awarded Heather Peters $9,867 on Wednesday, saying Honda did mislead her about the expected mileage.

"At a bare minimum Honda was aware ... that by the time Peters bought her car there were problems with its living up to its advertised mileage," he wrote in the judgment.

Peters opted out of a class-action lawsuit so she could try to claim a higher payment for the failure of her Civic to deliver the 50 miles per gallon that was promised when she bought it.

Informed of the decision by The Associated Press, Peters exulted, "Wow! Fantastic."

"I am absolutely thrilled. Sometimes big justice comes in small packages," she said. "This is a victory for Honda Civic orders everywhere."

Honda hadn't seen the decision Wednesday afternoon but planned to issue a statement after it was reviewed, said spokesman Chris Martin.

Peters, a former lawyer, hoped to inspire a flood of lawsuits by the other 200,000 owners of the Hybrid Honda Civic model sold in 2006. She said that if all 200,000 owners of the cars sued and won in small claims cost, it could Honda Motor Co. $2 billion.

She launched a website, DontSettleWithHonda.org, and said she was contacted by hundreds of other car owners seeking guidance in how to file small claims suits if they opted out of a class-action case already filed.

The upside of small claims court is that there are no attorneys' fees and cases are decided quickly. Individual payments are far greater than in class-action cases.

Honda's proposed class-action settlement would give aggrieved owners $100 to $200 each and a $1,000 credit toward the purchase of a new car. Legal fees in the class action case would give trial lawyers $8.5 million, Peters said.

Legal experts had said it was unlikely that all owners would take the small claims route because of the time and energy involved in pursuing such lawsuits. But it was a unique approach that could have an impact.

Carnahan held two hearings on the claim in January.

Peters claimed her he car never came close to the promised 50 mpg and that it got no more than 30 miles per gallon when the battery began deteriorating. She still owns the car and wanted to be compensated for money lost on gas, as well as punitive damages, amounting to $10,000.

A Honda technical expert who testified at an earlier hearing said the company was required by federal law to post the sticker estimating the highest mileage the car could get. But he said the mileage varied on how the car was driven. The company said Peters was not deceived.

A judge in San Diego County is due to rule in March on whether to approve Honda's class-action settlement. Members of the class have until Feb. 11 to accept or decline the deal.

Small claims courts generally handle private disputes that do not involve large amounts of money. In many states, that means small debts, quarrels between tenants and landlords and contract disagreements. Attorneys aren't usually there; in California, litigants aren't allowed to have lawyers argue their case.

The limit for small claims damages in California is $10,000. In other states it ranges from $2,500 to $15,000.

SANTO DOMINGO, Dominican Republic ? Authorities in the Dominican Republic say a man locked himself in a room with his former girlfriend and set it on fire, killing them both.

Police say in a statement that 35-year-old Edwin Figueroa was upset that 24-year-old Miguelina Pacheco didn't want to get back together with him. They say he sneaked into her parents' house early Tuesday and went into her room while she slept. Then he set the room on fire.

The victim's mother told reporters that the couple had been together for eight years but that she broke up with Figueroa five months ago because of his jealousy.

The fire occurred in a neighborhood west of the capital of Santo Domingo.
